2022年青岛市知识产权发展与保护状况

2022年，在市委、市政府的正确领导下，全市知识产权事业坚持以习近平新时代中国特色社会主义思想为指导，深入学习贯彻党的二十大精神，认真落实习近平总书记关于知识产权工作的重要指示论述和党中央、国务院决策部署，坚持政治引领、服务大局，落实为要、质量优先，将知识产权工作嵌入新发展格局，着力打造市场化、法治化、国际化一流营商环境，知识产权综合实力取得新的重要进展，知识产权强市建设迈出新的坚实步伐，为经济社会高质量发展提供了有力支撑。
一、强化高位引领，知识产权政策支撑持续增强
市委《关于深入学习宣传贯彻党的二十大精神的决议》对“建设国家知识产权保护中心（青岛）”作出明确部署，有力促进全市知识产权保护体系完善提升。
市政府召开全市标准化委员会全体会议暨知识产权保护工作会议，分析知识产权保护面临的形势，安排部署知识产权保护工作重点任务，市政府主要领导出席会议并讲话。
市政府印发《青岛市创建国家知识产权强市建设示范城市工作方案（2022-2025年）》，对创建国家知识产权强市建设
示范城市作出全面部署，深化构建城市、县域、园区的知识产权强市建设体系。
按照省委年度督查考核计划要求，省政府对各市党委、政府贯彻党中央、国务院和省委、省政府决策部署，以及推进知识产权保护整体工作进行了全面检查评议,我市获得优秀等次。
市十七届人民政府第13次常务会议传达学习《知识产权强国建设纲要（2021-2035年）》《山东省知识产权强省建设纲要（2021-2035年）》（以下简称“国家和省《纲要》”），强调各级各有关部门要深入贯彻落实国家和省《纲要》，推动知识产权工作不断迈上新台阶。
市
知识产权工作领导小组办公室印发《2022年青岛市打击侵犯知识产权和制售假冒伪劣商品工作要点》《青岛市2022年打击侵权假冒宣传工作方案》，统筹推进各项任务落实。做好省打击侵权假冒绩效年度考核工作。
青岛市科技创新委员会办公室制定《青岛市科技企业孵化财政资金股权投资运行管理办法（试行）》，其中，“硕果金”择优支持具有自主知识产权的高端科技人才创办或参与的企业，包括但不限于“两院”院士、行业领军人才、海外高层次人才、优秀大中型企业高管等各类人才。
市市场监管局在全国率先探索市场监管服务型执法，突出执法事前、事中、事后三个环节，创新实施“体验式”监管、“手术刀式”执法、“康复式”回访服务，构建“预防为主、轻微免罚、重违严惩、过罚相当、事后回访”执法新模式，得到国家市场监管总局肯定，被国家标准委确定为第八批社会管理和公共服务综合标准化试点项目。
市市场监管局会同市财政局制发《知识产权补助资金使用管理实施规程》，贯彻落实市政府《关于贯彻落实省支持八大发展战略财政政策加快重点产业高质量发展的若干政策》，促进全市知识产权专项资金补助落地见效。
市市场监管局联合市财政局、青岛银保监局制定《青岛市企业知识产权保险扶持项目管理实施规程》，对企业自愿投保的知识产权海外侵权责任险、专利执行险、专利被侵权损失险等保险产品给予保费补贴，降低企业维权成本。
市中级法院出台《青岛市中级人民法院知识产权智能3D证据管理规定》，深化完善全省首创的“智能3D证据管理系统”应用，实现与最高人民法院“知识产权法庭信息管理系统”及全省法院“全流程网上办案系统”无缝对接，进一步推动该系统规范化体系化建设。
市检察院全面推开知识产权检察职能集中统一履行工作。在全省率先将原下设第四检察部的知识产权检察办公室，作为市院机关临时内设机构独立运行。全市10个区（市）基层检察院全部组建知识产权检察办公室或办案组，专门从事知识产权刑事、民事、行政、公益诉讼检察工作，构建“捕、诉、监、防、治”全链条一体化保护格局。市院知识产权检察办公室被最高检确定为办案联系点，成为全国知识产权检察办案质量、办案信息及典型案例重点培育的34个基地之一。
市文化和旅游局出台《关于促进文化产业和旅游业高质量发展的实施意见》，支持版权交易平台做大业务增量，鼓励文创、音乐、影视、戏曲等原创作者登记、交易优秀作品。
青岛海关推广应用“知识产权状况预确认”创新举措，促进合法货物便利通关，已实施11批次，涉及32个中外知名品牌，商品逾10万件。该创新做法作为全省唯一案例入选国务院知识产权战略实施工作部际联席会议办公室发布的第一批25个知识产权强国建设典型案例。
下发《关于进一步加强知识产权保护便利企业创新维权的通知》，要求关区海关采用电话调研、网络互动等形式对企业开展摸底调研，结合促进外贸保稳提质工作，积极引导企业运用知识产权海关保护措施保护合法权益。
自贸试验区青岛片区联合济南片区、烟台片区发起知识产权跨域协同保护“3+2+1+1”新模式，在济南、青岛、烟台三个片区分别设立知识产权跨域协同保护协作中心；建立线索通报机制、统一执法程序与执法标准；搭建一个知识产权跨域协同保护信息共享平台；设立一个海外知识产权纠纷应对指导服务站，全面提升山东自贸试验区知识产权跨域协同保护水平。
二、激发创新活力，知识产权创造质量持续提升
专利创造量升质优。2022年，全市新增发明专利授权量1.45万件，同比增长42.2%；有效发明专利拥有量5.94万件，同比增长26%；每万人口有效发明专利拥有量58.99件；PCT国际专利申请2351件，同比增长24.1%。全市发明专利授权量、有效发明专利拥有量、每万人口有效发明专利拥有量和PCT国际专利申请量均居全省第1位。在第23届中国专利奖评选中，我市共获金奖1项、银奖3项、优秀奖16项。
商标注册稳步发展。2022年，全市商标申请量9.04万件；商标注册量7.23万件；驰名商标总量达152件。截至2022年底，全市有效注册商标总量达到45.77万件。
地理标志成效显著。拓展地理标志“标志-品牌-产业”发展路径，推动地理标志与特色产业发展有机融合。“国家地理标志产品保护示范区（山东平度）”获得认定；“胶州大白菜山东省地理标志产品保护示范区”获批筹建，同时，“胶州大白菜”获批省级地理标志运用促进工程，并推荐上报国家级地理标志运用促进工程。截至2022年，全市拥有崂山绿茶、即墨黄酒等7个地理标志保护产品和北宅樱桃、宝山蓝莓等35件地理标志证明商标。
版权登记效果良好。始终坚持免费为著作权人提供版权登记服务，为著作权人节省了大量版权确权登记费用。2022年以来，全市办理作品版权登记达8000余件，6家单位新获评省“版权示范单位、园区（基地）”。
涉农知产不断扩张。2022年，全市通过省审定主要农作物品种有8个，全市累计156个，通过国家登记的非主要农作物品种85个，累计1134个。共培育“三品一标”农产品1029个，其中国家地理标志农产品54个，数量继续居副省级城市首位。“店埠胡萝卜”和“仁兆蒜薹”两个产品实施国家地理标志农产品保护工程项目。里岔黑猪、五龙鹅被列入国家级畜禽遗传资源保护名录；崂山奶山羊被列为国家畜禽遗传资源名录；琅琊鸡被列为省畜禽遗传资源保护名录。
三、促进转化运用，知识产权赋能产业持续加力
高价值专利培育取得新成果。组织开展2022年度市级关键核心技术专利组合（专利池）评选，在重点产业领域面向海尔、海信等大型企业，完成26项关键核心技术专利组合（专利池）的受理工作，遴选“多色激光投影光源及消散斑技术及应用专利组合”等关键核心技术专利组合（专利池）18项，培育重点产业关键核心技术领域竞争优势，增强产业集群创新引领力。
专利导航项目取得新成效。贯彻落实《专利导航指南》系列国家标准，以产业、专利数据为基础，以全市24条重点产业链为方向，组织开展企业经营类专利导航36项，择优遴选“中央空调智能化控制技术专利导航”等市级专利导航项目20项；“轨道交通智能检修专利导航”等3个项目确定为2022年山东省省级专利导航；支持重点园区创建专利导航服务基地，青岛高科技工业园获批国家级专利导航服务基地。年内，新增国家级知识产权示范企业11家，优势企业100家。
专利技术转移转化试点取得新进展。面向高校、科研院所、国有企业和专利服务机构，在确定的两批省专利技术转移转化专项计划14家试点单位推行专利开放许可试点工作。
构建知识产权运营生态取得新发展。实施中小企业知识产权战略推进，扶持“专精特新”企业发展，促进高校、科研院所知识产权转化运用。开展知识产权质押融资“入园惠企”行动，助力中小企业创新发展。深化知识产权运营中心建设，开展智慧家庭产业高价值知识产权培育、专利标准化和专利投融资等知识产权运营服务，带动全国智慧家庭产业升级发展。
四、加大保护力度，知识产权保护质效持续提高
（一）强化知识产权行政保护
全力推进国家级知识产权保护中心筹建。为积极贯彻市委、市政府关于建设国家知识产权保护中心（青岛）的决策部署，设立国家级知识产权保护中心筹建专项工作组，坚持高起点定位、高标准谋划、高质量推进，申报材料已经省市场监管局审核通过并上报至国家知识产权局等待审核批复。
国家级知识产权快速维权中心获批建设。青岛西海岸新区（机电产品）知识产权快速维权中心获批建设，成为国内首个机电领域国家级快速维权中心。待获批运行后，企业外观设计专利授权将由6个月缩减到1-2天，实现“开发即保护”；专利侵权纠纷行政处理将由4个月缩减至2个月，实现“发现即解决”。
市市场监管局2021年度全国知识产权行政保护工作绩效考核获得国家知识产权局表扬。市市场监管局一名同志荣获国家知识产权局、公安部2021年度全国知识产权系统和公安机关知识产权保护工作成绩突出个人通报表扬。办理的“家具系列外观设计专利侵权纠纷案”入选国家知识产权局发布的2021年度专利行政保护十大典型案例。查处的销售假冒专利药品案、“灰渣陶瓷真空过滤装置”专利侵权纠纷案分别获评2022年度全省知识产权行政保护工作案卷评查优秀案卷、优秀文书。
深入开展全系统知识产权领域“铁拳”执法行动，全年共组织办理商标侵权案件502件，罚没金额421.7万元，移送司法机关案件7件；立案处理专利违法行为127件，罚没款47.3万元。立案查处侵犯奥林匹克标志违法案件28起，移交公安机关线索5起。对恶意抢注奥运健儿姓名及相关热词商标违法行为进行严厉打击，共对20家企业、11家商标代理公司进行立案处理、约谈整改。
推进省级专利侵权纠纷行政裁决试点。在全市开展专利侵权纠纷委托行政裁决、行政调解工作,10个区市局已全部接受委托，西海岸流动口审厅已建设完毕，指导各基层局立案受理专利侵权纠纷案件16起。
发挥知识产权行政裁决优势，规范专利侵权纠纷行政裁决程序，畅通受理渠道，压缩办案期限，高效定分止争。年内共处理专利侵权纠纷113起，有效维护了专利权人的合法权益。
市文化和旅游局开展打击网络侵权盗版“剑网 2022”专项行动，强化北京冬奥会版权保护工作，开展院线电影专项保护行动，做好版权纠纷调解。2022年，立案查办版权行政处罚案件112件，其中，办结网络侵权盗版案件18起，查缴各类侵权盗版制品及非法出版物200余件（册、盘）。成功调解版权侵权纠纷7起，达成调解协议金额400余万元。
在冬奥版权保护专项行动中，查处的某培训机构通过制作传播冰墩墩形象侵权视频开展商业宣传、牟取不当利益行为案，作为涉冬奥版权保护典型案件被“求是”官网圆点直播面向全国宣传推广。
市农业农村局扎实开展种业执法监管年等系列执法行动，共出动执法人员1.62万人次，检查各类场所1.23万家次，查办农业领域违法案件961起，罚没款493.32万元，销毁假劣农资25吨。
市生态环境局每季度在局官方网站公布危险废物经营单位名单及相关信息，积极与相关执法部门沟通对接，做好侵权假冒商品无害化销毁咨询引导。强化无害化处置单位环境监管，普及固体废物安全处置知识，推动完善全市危险废物处置能力。
青岛仲裁办公正高效仲裁各类知识产权纠纷，2022年，共受理知识产权纠纷案件553件，争议标的4495.69万元，涉案标的4510.65万元，标的额同比增长11.7%；共审结各类知识产权纠纷564件，争议标的额9082.21万元，涉案标的2.6亿元，结案率达100%。
市烟草专卖局建立“一主多专”情报分析体系和烟草专卖信用管理体系，初步构建了卷烟打假打私 “海、陆、空”立体化的防控措施，严厉打击了我市辖区假冒卷烟海上走私、烟丝烟叶等原辅料非法经营和烟草专卖品非法运输中转等违法活动。2022年，共查处涉烟案件1623起，查获违法卷烟2864万支，案值2699万元，其中，假冒卷烟案件195起，查获假冒卷烟203.44万支，案值228.06万元。依法处置涉烟违法分子301人次，其中，刑事拘留150人，逮捕54人，判刑97人。破获公安部、国家烟草专卖局标准网络案件9起，其中，部级督办案件1起，荣获国家烟草专卖局表彰的重特大案件4起。
（二）严格知识产权司法保护
市中级法院加强知识产权案件审理。2022年，全市法院系统知识产权案件收案4275件，结案4536件。青岛知识产权法庭收案1028件（其中，一审756件，二审272件），结案1300件，其中，专利、植物新品种、计算机软件、技术秘密等疑难复杂技术类案件占一审案件43.77%。
“饿了么”诉“美团”“二选一”不正当竞争案入选省高院、最高法院工作报告。“刷单炒信”案入选中国法院10大知识产权案件。“长碳链二元酸”案入选中国法院50 件典型知识产权案例。“混凝土搅拌拖泵”等两起案件入选《最高法院知识产权法庭裁判要旨》。“玉楼春”诉前禁令案等7个案件入选全省法院10大知识产权案件。GOLFZON VISION计算机软件著作权侵权案入选全省著作权保护十大案件。“CK”商标侵权案入选年度中国外商投资企业协会品牌保护委员会知识产权十佳案例。青岛法院在全省法院知识产权专业化审判二十周年精品评选中是全省获奖最多的中级法院。
出台《青岛市中级人民法院专家陪审员使用管理办法（试行）》《青岛知识产权法庭技术调查官参与诉讼活动办法》《青岛知识产权法庭专家咨询委员会章程》，完成第二批技术咨询专家、技术调查官选聘工作，聘任兼职技术调查官28名、技术咨询专家54名，形成技术调查、技术咨询、专家陪审和技术鉴定“四位一体”的技术事实查明体系。
知识产权案件管辖布局进一步优化。积极争取李沧、胶州法院获批知识产权案件管辖权，目前我市创新高地所在的6家法院均拥有知识产权案件管辖权。积极推动知识产权审判“三合一”工作开展，两级法院均实现知识产权案件集中管辖。
市检察机关依法从严批捕起诉侵犯知识产权犯罪案件。2022年，全市检察机关共办理生产销售假冒知名品牌食品、服装、家居，销售贴牌卫浴等各类侵犯企业知识产权案件200余件，有效维护了企业合法权益。向人民法院、行政机关制发各类检察建议40余份，督促整改审判程序、执行活动违法及怠于执法履职等问题20余个，取得良好法治效果。
在办理知识产权案件中同步审查是否涉刑事追诉、民事追责、行政违法、公益损害等情形，完善案件一体化审查办理机制。加强上下级院联动，积极构建两级检察机关案件线索统一管理、办案力量统一调配、办案工作统一指挥、案件信息统一发布的一体化联动办案机制。
市检察院办理的青岛某旅行社申诉北京某网络科技公司摄影作品著作权案系全省首例由市级院提请抗诉并获省院抗诉的知识产权民事裁判结果监督类案件。即墨区院办理的孙某林等假冒注册商标、销售假冒注册商标的商品案入选2022年度全省检察机关知识产权检察职能集中统一履行典型案例。
市公安机关加大知识产权犯罪刑事打击力度。组织开展“昆仑2022”、“助力冬奥护航两会”、“百日行动”等专项行动，2022年，全市共侦破各类侵犯知识产权和制售伪劣商品犯罪案件67起，抓获犯罪嫌疑人268名，其中，侦办公安部督办案件3起。
2022年10月，市公安局成功侦破“10.28”假冒注册商标案，抓获犯罪嫌疑人38名，打掉侵权犯罪团伙12个，捣毁生产销售、仓储窝点23处，涉案市场价值近1.7亿元人民币。公安部发贺电对案件成功侦办予以表彰。
市公安局食药环侦支队获得国家知识产权局、公安部2021年度全国知识产权系统和公安机关知识产权保护工作成绩突出集体通报表扬。
（三）加强知识产权海关保护
青岛海关严格知识产权边境保护。2022年，共采取知识产权保护扣留措施2161批次，扣留侵权嫌疑货物58.79万件，同比分别增长13.2%和0.5%，查办的知识产权案件连续16年入选中国海关知识产权保护典型案例。
开展打击货运渠道侵权假冒机动车零配件专项执法行动，查扣滤芯、滤清器等及侵权商品共计21万件，有力维护了国内外市场公平秩序和人民群众健康财产权益。
（四）推进知识产权协同保护
市中级法院在跨域巡回审判已实现全覆盖的基础上，在中国（烟台）知识产权保护中心设立烟台第二个巡回审判庭。与威海市市场监管局、威海市中级法院签订跨域保护合作协议。与潍坊市市场监管局等建立“三级多向”快速处理工作方案。举办“胶东半岛知识产权司法与行政协同保护”工作交流会，进一步提升胶东半岛地区司法便民利民水平。创建符合知识产权案件特点的跨网域异步质证系统，实现了远程庭审与质证。
市检察院总结知识产权检察监督点，对案件数据进行分析，批量发现监督线索，制成各类大数据模型，融入市知识产权快速协同保护数据共享平台，形成网上知识产权保护衔接机制。
青岛海关与济南海关、省市场监管局会签《加强重点领域战略合作协议》，重点加强知识产权案件线索通报和执法协作，优化对企知识产权服务。与青岛市公安局建立线索共同研判工作机制，依托公安系统的大数据平台实现对侵权线索的共享互通，查办的山东济宁某公司出口“POKEMON”（宝可梦）早教卡案经移交公安机关办理，被列为省公安厅督办案件。
青岛仲裁办与RCEP山东企业服务中心平台建立联合服务合作机制，帮助企业更好地掌握和应用RCEP经贸规则，常态化开展业务咨询、纠纷调解、案件审理等事项，为我市RCEP经贸合作先行创新试验基地创新主体提供专业化、国际化的仲裁法律服务。
五、着力监督管理，知识产权行业秩序持续规范
市市场监管局按照省局部署，加强对青岛英派斯健康科技股份有限公司等3家入选2022年度重点产业知识产权海外侵权风险防控项目企业、青岛天安数码有限公司等4家入选2022年度山东省知识产权保护工作站项目企业的监管指导，组织项目实施单位与市局签订项目合同，推动项目实施单位落实好各项任务要求。
建立专利快速预审申请主体备案工作机制。服务创新主体高价值发明创造快速预审，推荐生产、研发或者经营方向属于海洋、新一代信息技术产业领域的企业和代理机构，开展申请主体集中审核备案工作，累计审核130家企业完成专利快速预审申请主体备案。
持续严格规范专利申请行为，开展非正常专利申请核查。在严格核实相关单位、个人研发情况和创新能力基础上。完成两批非正常发明专利申请的核查任务，向省市场监管局审核推荐309家专利申请精准管理名单。
开展“双随机、一公开”知识产权服务行业监管抽查，检查专利代理机构58家、商标代理机构329家，对发现轻微不规范经营行为的21家进行批评指正和规范。
市文化和旅游局抓好政府软件正版化长效机制建设，市软件正版化工作联席会议对成员单位职责作进一步调整，督促各区（市）建立完善软件正版化工作制度，坚持在“回头看”核查中保持先进态势。
六、切实优化服务，知识产权服务效能持续改善
市市场监管局指导国家知识产权服务业集聚发展示范区——崂山区通过国家知识产权局验收评估。“示范区”涵盖知识产权代理、咨询、评价、分析、交易、转化、质押、投融资等业务范畴，知识产权服务机构达到220家、从业人员达到1200余人，知识产权服务持续向专业化和价值链高端延伸，各业态协同发展的知识产权服务体系基本形成。
开展专利权质押登记线上办理试点。积极争取中国银保监会、国家知识产权局批复同意，使青岛成为第二批国家知识产权质押登记线上办理试点地区。会同青岛银保监局、市地方金融监管局印发《青岛市知识产权质押登记线上办理国家试点工作方案》《青岛市知识产权质押登记线上办理试点业务管理办法》，支持辖内首批18家试点银行机构线上办理知识产权质押业务。截至2022年底，全市市累计开办专利权质押贷款保险459笔，累计保险金额17.45亿元，贷款金额16.63亿元，惠及企业726家。
知识产权服务不断深化。世界知识产权组织技术与创新支持中心（简称TISC）青岛分中心宣传国家知识产权政策、世界知识产权组织（简称WIPO）优质资源及国际标准。国家海外知识产权纠纷应对指导中心青岛分中心，建立以指导信息处理中心、能力支撑中心和协调服务中心为框架的海外纠纷应对指导工作体系，在全球12个国家（地区）设立海外办事处，在全市建立了14个联络站、4个联络站分站、10个支持机构，协同各区市服务企业创新发展“走出去”。
省内首个知识产权法律服务联盟——“青岛西海岸新区知识产权法律服务联盟”成立。该联盟由西海岸新区中外企业联合会维权委员会牵头、山东科技大学知识产权学院、山东文康律师事务所等39家单位联合发起，采取理事会运行模式，成员包括国内知识产权人才库知名专家、全国律协知识产权专业委员会知名律师等，旨在为区域内企业知识产权纠纷化解、维权诉讼提供专业化、高水平的法律服务。
市中级法院赴莱西莱阳一体化发展先行区、北京汽车制造厂（青岛）有限公司及青岛微电子创新中心、青岛海洋生物研究院等企业进行走访调研，为区域高质量发展和集成电路、生物医药等新型产业发展提供司法保障服务。
市检察院组织海尔、海信、青啤等9家知名企业参加知识产权保护座谈会，倾听企业意见，从检察履职角度为企业提供定制化知识产权服务。开展“送法进企业”系列专题活动，对全市18家重点企业进行实地普法宣传。
市文化和旅游局积极向省委宣传部申请，依托青岛文化产权交易中心建设山东数字版权交易中心。指导青岛文化产权交易中心打造音乐版权服务平台，并承担全省唯一的国家“区块链+版权”创新应用试点任务。
青岛仲裁办联合中国贸促会商事法律服务中心、市税务局、市贸促会、市北区政府等部门以及驻青高校、知识产权服务机构，举办第二期RCEP政策解读与利用线上实务培训，为外贸企业提供更加精准的知识产权领域服务。
青岛海关协助企业开展知识产权企业海关备案工作，2022年，省内新增知识产权海关备案597件，新增权利人130个，持续保持高速双增长。遴选新增济宁海航发制品有限公司等5家国内自主知识产权重点企业，关区重点企业总数增至47家。
七、加强基础建设，知识产权人文环境持续良好
(一)开展知识产权培训，夯实知识产权发展根基
市
市场监管局强化与青岛大学、山东科技大学合作，发挥知识产权学院作用，不断推进学历教育和社会化培训。发挥市知识产权公共服务平台和专业服务机构优势，实施公益培训项目，对企事业单位高管、知识产权工作者、科研人员等等，分类分层次开展培训工作，累计举办公益培训900余场，培训人员近2万人次，壮大了知识产权专业队伍。
市中级法院选派法官为跨域区域进行培训，提高跨域知识产权案件多元纠纷化解水平。组织召开知识产权案件管辖调整工作座谈会、知识产权业务培训交流会，提升两级法院审判能力。
市文化和旅游局组织全市党政机关和主要企事业单位负责人，开展软件版权法律知识、软件资产管理和软件技术知识培训，提升全市版权执法人员专业素质和相关企业守法自律意识，为软件正版化的深入推进奠定坚实基础。
市司法局组织市律师协会知识产权委员会与有关司法、行政执法机关和企事业单位代表，举办“世界知识产权日座谈会暨知识产权惩罚性赔偿制度适用研讨会”；与市知识产权公共服务平台合作举办《专利侵权判定与专利侵权诉讼》培训讲座；与南京律师协会知识产权专委会联合举办知识产权法律业务座谈沙龙等知识产权培训研讨等活动。
青岛海关发布《知识产权保护执法问题解答》（第二版），组织开展业务培训3期，参训300余人次，进一步规范全员执法水平。在关区成立4个项目组开展课题研究，课题涵盖自贸试验区知识产权海关保护创新举措、《区域全面经济伙伴关系协定》等方面的执法疑难问题，提升海关队伍专业素养。积极参与《一带一路国家知识产权保护制度研究》数目撰写和《知识产权保护文告解读》编纂工作，拓展知识产权工作视野。
（二）加强知识产权宣介，厚植知识产权保护理念
2022年6月20日，“第三届跨国公司领导人青岛峰会跨国公司知识产权保护论坛”在青岛成功举办。国家知识产权局副局长胡文辉、省政府副省长凌文出席论坛并致辞。国家知识产权局知识产权保护司、省市场监管局和省高级人民法院相关负责同志以及跨国公司代表发表主旨演讲。论坛结束后，国家知识产权局召开了闭门会议，国家知识产权局知识产权保护司和省市场监管局相关负责同志认真听取了跨国公司代表对中国知识产权保护工作的意见建议，参会各方围绕知识产权执法保护、海外维权等议题进行了深入交流。
市知识产权工作领导小组办公室充分利用“4.26世界知识产权日”、“全国知识产权宣传周”、“知识产权服务万里行”等时机，发动各成员单位和各区市相应议事协调机构组成部门，运用传统媒体与新媒体相结合形式，开展知识产权系列宣传活动，强化全社会知识产权保护意识。

市中级法院与市检察院共同召开新闻发布会，发布青岛知识产权司法保护情况和十大典型案例。与市律师协会共同举办知识产权惩罚性赔偿制度适用研讨会。积极参与中国法院网“知识产权青年说”“知识产权强国建设”公益大讲堂活动。加强知识产权司法保护的创新举措被《人民法院报》、最高法院《知识产权审判动态》、省高院《知识产权审判参考》、《青岛改革》进行了推广宣传。
市文化和旅游局发布《拒绝侵权盗版保护知识产权》倡议书，组织现场宣传活动50余场，发放版权宣传材料、图书6千余份，营造“尊重版权保护版权”的良好氛围。举办2022年“绿书签行动”系列宣传活动，制作公益宣传片、短视频4部，印制发放书签、宣传册8千余件，发放“绿书签”宣传页1.5万余页（张），提升青少年安全意识和法治素养。
举办第五届青岛国际版权交易博览会，期间开展了线上交易、展览展示、高峰论坛、保护宣传四大板块活动，展会规模达2万平方米，汇聚国内外优质版权企业188家参展，吸引来自全国各地6000余人观展，意向签约交易额达30亿元。
青岛海关在学习强国平台、大众日报、国门时报等媒体宣传知识产权海关保护政策和案例10余次。与市市场监管局、市文化和旅游局等知识产权管理部门合作在报关大厅贴宣传海报，发放宣传手册2千余份，覆盖辖区企业200余家。

in Qingdao 2022
Under the guidance of Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, and the wise leadership of CPC Qingdao Committee and Qingdao Municipal Government, the city earnestly implemented key spirits of the 20th CPC National Congress and plenary sessions, decisions and arrangements of the CPC Central Committee and the State Council on intellectual property (IP) protection in 2022. Qingdao stepped up the development of IP undertakings, and incorporated new development pattern to facilitate first-class business environmentfeatured onrule-of-law, market orientation and internationalization. Solid efforts have beengeared up to build a city with strong IP protection competence, furnishing high-quality economic and social development.
I. High level guidance seals intensified policies
Resolution on In-depth Study, Promotion and and Implementation of the Spirit of the 20th CPC National Congress, issued by CPC Qingdao Committee, and the 2023 Government Work Report of the Qingdao Municipal Government (QMG),defined clearly the deployment of building the National IP Protection Qingdao Center (hereinafter referred to as “Qingdao Center”), to facilitate completeand sound system.
QMGconvenedplenary session of standardizing committee and IP work meeting to analyze current condition and arrange key tasks. Major government leaders presented and addressed at the meeting.
QMGissued the Work Plan for Qingdao to Build a Demonstration City Strong in IP Protection (2022-2025), for the overall deployment and deepening of a strong IP system over cities, counties and parks.
To implement decisions and requirements of the CPC Central Committee and the State Council, Shandong Provincial Committee and Government, cities in Shandong were evaluated and assessed on IP protection work. Qingdao won excellent awardfor annual supervision and assessment.
The 13thplenary session of QMG conveyed and studied the National Strategy Compendium for the Development of IP Powerhouse (2021-2035)and Shandong Outline for a Strong IP Province (2021-2035) (hereinafter referred to as the Compendium and Provincial Outline), to define local specific tasks and facilitate new progress.

ingdao Leading GroupOffice for IP Affairs(hereinafter referred to as “the Leading Group”) formulated and issued the2022 Key Tasks on Cracking Down IP Infringement and Counterfeitingand Qingdao Work Plan for Combating Infringement and Counterfeiting, coordinating the implementation of various tasks and annual performance appraisal work.
Qingdao Science and Technology Innovation Committee formulated Management Measures (Trial) on Financial Fund Equity Investment for Qingdao Sci-Tech Businesses. The “Shuoguo Fund”incubation center selectedadvancedbusinesseswith independent IP and high-end talents on science and technology, including but not limited to academicians of Chinese Academy of Sciences and Engineering (“CAS” and “CAE”), industry leadership, overseas high level talents, senior executives of large and medium-sized businesses.
Qingdao Administration for Market Regulation (QAMR)pioneered in exploring service-oriented law enforcement over the nation, highlighting operation beforehand, in the middle and afterwards oversight, “immersing” supervision, “scalpel” approach, and “recovery” return visit. A new law enforcement model has been built featuring “prevention first, minor exemption from punishment, severe punishment for serious violation, error-equivalent punishment, and return visit”. It was well-received by the State Administration for Market Regulation (SAMR) and identified as pilot projects for standard social management and public services by the Standardization Administration.
QAMR and the Qingdao Municipal Bureau of Finance (MFB) jointly formulated and issued the Rules for the Management and Application of IP Subsidy Funds, implemented Several Policies on Implementing Provincial Level Fiscal Support for High-quality Development of Key Industries over Eight Major Strategies, so as to ensure the feasibility of special fund and subsidies.
QAMR works with MFB and China Banking and Insurance Regulatory Commission Qingdao Office (CBIRC), formulated the Rules on IP Insurance Support Projects for Qingdao-based Businesses, to provide premium subsidies and reduce costs for such voluntaryinsurance products as overseas infringement liability, patent enforcement, and patent infringement loss.
The Qingdao Municipal Intermediate People’s Court (QIPC) issued the QIPC IP Intelligent 3D Evidence Management Regulations, to improve the pioneering application of “intelligent 3D evidence management system” over the province. Directconnectionhas been realized with the “IP Court Information System”of the Supreme People’s Court (SPC)and the “Whole Process Online Case Handling System” of provincial courts, so as to ensure standard and systematic construction of the system.
People’s Procuratorate of Qingdao (QPP) delivered centralized and unified procuratorial functions of IP, and took the lead in independent operation of IP Procuratorial Officeas a temporary internal organ. All the grassroots procuratorates at city and district level have formed prosecution offices or case-handling groups, specializing in IP criminal, civil, administrative, and public interest prosecution, striving for an integrated protection pattern of “arresting, prosecution, supervision, prevention and treatment”. QPP IP Office serves as one of the 34 key bases to contact Supreme People’s Procuratorate (SPP) for high quality and major case handling, and sharing information.
Qingdao Culture and Tourism Bureau (QCTB) proposed the Implementation Opinions on Promoting High-quality Development of Cultural and Tourism Industries, to support a growing number of copyright tradings over platform, and encourage the registration and trading of excellent cultural and creative, music, film and television, and opera works with original creators.
Qingdao Customs District of China (QCD) creatively proposed “pre-confirmation measures” to facilitate Customs clearance of legal products, involving 100,000 goods of 32 well-known domestic and foreign brands. It has been one and the only case being selected into the first batch of 25 typical cases for IP powerhouse released by the State Council Inter-ministerial Joint Conference on IP Strategy.
Notice on Further Business Innovation and IP Protection was issued, requiring QCD to conduct telephone and online investigation to ensure high quality foreign trade work and protect legitimate rights and interests of enterprises over guidance.
Pilot Free Trade Zone Qingdao Area, Jinan Area and Yantai Area, coordinated in launching a new protection model of building cross-domain cooperation centers for IP protection in Jinan, Qingdao and Yantai, a platform for clue sharing, with unified law enforcement procedures and standards. Service platform for overseas IP disputes was set up to improve cross-domain IP protection of Shandong.
II. New vigor nurtures innovation and quality
Patent creation was boostedboth in quantity and quality.In 2022, Qingdao completed the examination of 14,500 invention patent applications, a year-on-year increase of 42.2%, making up valid invention patentsof 59,400 in total,up 26%. The number of invention patents per 10,000people reached58.99. A total of 2,351 international patent applications were filed under Patent Cooperation Treaty (PCT), an increase of 24.1%. Qingdao ranked top in the province over the above aspects.In the 23rdChina Patent Award, Qingdao won one gold medal, three silver medals and 16 excellent awards.
Steady growth was guaranteed in trademark registration.Through the year, the city completed examination of 90,400 trademark applications, and 72,300 were registered upon approval. The city’s well-known trademarks aggregated to 152, and valid trademark registration amounted to 457,700.

eographical indications (GIs) exercises positive results.A new format was explored to involve GIs in brands and featured industries. Pingdu city in Shandong was designated as National Demonstration Zone for GI Product Protection. Jiaozhou Chinese Cabbage GI Demonstration Zone of Shandong was approved for establishment. “Jiaozhou Chinese Cabbage” was selected as provincial GI promotion project, and recommended to be national GI project. By 2022, the city owns 7 GI products including “Laoshan Green Tea” and “Jimo Rice Wine” and 35 GI trademarks as Beizhai Cherry and Baoshan Blueberry.
Copyright registration processed smoothly. Free of charge services as copyright registration savesubstantial costs for copyright owners. Since 2022, the city has handled more than 8,000 copyright registrations, and 6 units newly rated as provincial “copyright demonstration units and parks (bases)”.
New breakthroughs 
were made in agricultural varieties.In 2022, 8major agricultural plant varieties were newly granted through provincial review, reaching a total number of 156. Moreover, 85minor varieties were newly filed at state, adding up to 1,134. “Three-food, one standard” agricultural products amounted to 1,029, covering qualified agricultural products, green food, organic food and GIs, and including 54 GI agricultural products, ranking top among provincial cities. “Dianbu Carrot” and “Renzhao Green Onion”were included into National GI Protection Project, and Licha Black Pig and Wulong Gooseselected into National Breed Protection List of Livestock and Poultry Genetic Resources. Laoshan Dairy Goat was listed into National Breed List,and and Langya Chicken into Provincial Breed Protection List.
III. Better results reflected in IP transformation
N
ew progress was made in fostering high-value patents.The 2022 selection campaign of patent portfolio (patent pool) on key technologies was launched all over the city. Among leading businesses such as Haier and Hisense, 26 portfolio (patent pool) with core technology were evaluated and 18 were selected including “multi-color laser projection light source and dissipative spot technology and application patent portfolio”, so as to preserve dominant position of core technology and cluster innovation.
Patent navigation program ushered in the city. The national standard implied in Patent Navigation Guide shall be earnestly implemented based on industrial and patent data. Qingdao took the direction of 24 key industrial chains, and organized 36 navigation projects, 20 of which included into municipal projects such as “patent navigation for intelligent control of central air conditioning”. 3 projects including “patent navigation of intelligent maintenance for rail transit” were identified as provincialpatent navigation project of the year. Key parks were nurtured to be patent navigation bases, and Qingdao High-tech Industrial Park approved as national base. Over the year, 11 national IP demonstration enterprises and 100 advantageous enterprises were newly added.
New Progress made in pilot program for patent transformation.14 units were open for pilot plans at national level serving universities, scientific research institutes, state-owned enterprises and patent service institutions.
Eco-operation of IP advanced in its formation. IP strategy of SMEs was promoted, and “specialized, professional and new” enterprises were supported to speed up IP transformation and application in universities and research institutes. Businesses within the park can enjoy IP pledge financing policies to facilitate innovation and development. IP operation center has been built up to provide such services as nurturing smart home high-value IP, patent standardization, and patent investment and financing, and drive the development of smart home industry over the nation.
IV. Protection efforts revealed in quality and effects
Stronger Administrative protection
In line with the decision and deployment of CPC Qingdao Committee and Qingdao Municipal Government, corresponding team was organized to step up the construction of Qingdao Center, positioned itself at high starting point, high-standard and high-quality. Application materials have been reviewed and approved by the Shandong Administration for Market Regulation (SDAMR) and reported toState Intellectual Property Office (SIPO) for review and approval.
Quick Service Center at national level was ready. QuickService Center at Qingdao West Coast New Area (mainly for Mechanical and Electrical Products) has been approved to be the first center of this kind over the nation. Upon its operation, design patents authorization cycle will be cut from 6 months to 1-2 days, realizing “protection upon appearance”, while patent infringement disputes shortened from 4 months to 2 months, realizing “resolution upon detection”.
SIPO commended QAMR in terms of performance assessment of IP protection work in 2021. One staff at QAMR received compliment of the year 2021 for outstanding performance on IP protection by SIPO and Ministry of Public Security of China (MPS). “Patent Infringement Dispute for Furniture Series Design” was handled and selected as one of the top 10 typical cases of SIPO on patent administrative protection in 2021. The case of selling counterfeit drugs was rated as excellent file, and ash ceramic vacuum filtration device infringement dispute as excellent document in 2022.
“Iron Fist” law enforcement against illegal IP practice was in full swing. 502 trademark infringement cases were investigated, involvingfines of 4.2 million yuan, and 7 cases were transferred to judicial organs. 127 illegal practices were put on file with punitive compensation volume reaching 473,000 yuan. 28 cases of infringement of Olympic symbols were filed, 5 of which handed over to the public security organs. Emphasis has been attached on cracking down illegal acts of preemptively registering the names of Olympic athletes and related hot word trademarks. A total of 20 enterprises and 11 trademark agencies were placed on file or for rectification.
Provincial pilot program was promoted over administrative adjudication of patent infringement disputes. Entrusted adjudication and mediation work were launched all over 10 districts and cities within Qingdao. The West Coast hall for flow approval has finished construction, guiding grassroots bureaus to handled and file 16 patent infringement dispute cases.
Administrative adjudicationstrength has been given full playto regulate and unify adjudication procedures, facilitate case acceptance, shorten handling time, and settle disputes.
Qingdao Culture and Tourism Bureau (QCTB) launched “Swordnet 2022” special action for cracking downInternet infringement and piracyto intensify copyright protection of the Beijing Winter Olympics.Special protection was conducted for theatrical films, and copyright disputes mediation.Over the year, 112 copyright dispute cases were handled and 18 online infringement cases settled, seizing over 200infringing and pirated products and illegal publications, and 7 copyright infringement disputes mediated, with mediation agreement of4 million yuan.
In the special action on copyright protection of the Winter Olympics, a training institution infringed Olympic icon image “Bing Dwen Dwen” by producing and disseminating videos for commercial publicity and seeking improper benefits. The case was publicized as a typical case for copyright protection on the Winter Olympics by “Qiushi Theory” network.
Q
ingdao Bureau of Agriculture and Rural Affairs (QARA) conducted extensive campaign to rectify illegal activities in seeds market. It dispatched over16,200person-times of law-enforcement personnel, inspected 12,300 operationalentities, investigated 961 illegal cases,fined over 4.93 million yuan, and destroying 25 tons of fake and inferior agricultural materials.
Qingdao Municipal Bureau of Ecology and Environment released the list of business units producing hazardous wastes and other relevant information on its official website every quarter. It intended to connect law enforcement departments and provide guidance on harmless destruction of infringing and counterfeit goods and dedicated to environmental supervision of harmless disposal units, education of solid wastesafe disposal, improving hazardous waste disposal capacity.
Disputes were settled in a fair and effective manner. In 2022, Qingdao Arbitration Commission (QAC)
accepted 553 IP dispute cases with a subject value of 44.96 million yuan, involving 45.1 million yuan, a year-on-year increase of 11.7%. 564 dispute cases were closed, subject value being 90.82 million yuan and involving 260 million yuan, with a completion rate of 100%.

hina Tobacco Monopoly Administration (CTMA) Qingdao Branchestablished “one master, multiple specialty" intelligence analysis system and tobacco monopoly credit management system, initially forming three-dimensional “sea-land-air” prevention and control measures for cigarette counterfeiting and smuggling. The city severely cracked down on illegal activities such as sea smuggling of counterfeit cigarettes, illegal operation of raw and auxiliary materials such as tobacco silk and tobacco leaves, and illegal transportation and transit of tobacco monopoly products. In 2022, a total of 1,623 tobacco-related cases were investigated, seizing 2.03 million illegal cigarettes, with a value of 2.28 million yuan. 301 criminal suspects were punished, including 150 detained suspects, 50 arrested and 97 sentenced. 9 online cases were cracked down, with one case being supervised by the Ministry of Public Security (MPS) and 4 serious ones commended by CTMA.
(2) Stringent Judicial protection
QIPC geared up case handling capacity. In 2022, c
ourts in Qingdao coped with4,275 IP-related cases, and concluded 4,536 cases. Qingdao IP Court received 1,028 cases (756 cases of first trial and 272 second trial), and settled 1,300 cases. The number of complex and technical cases including patents, new plant varieties, computer software and technical secrets took up 43.77% of first trial cases.
The either-or case of “Ele.me” to “Meituan” concerning unfair competition was selected into work report of Shandong Court and SPC. “Click farming and inflating credit” case was included into top 10 IP cases at national level, and the “long carbon chain diacid” case as one of the 50 typical cases. Two cases, including “concrete mixer trailer pump”, were selected into the Essence of IP Court Tribunal Judgment of SPC. Seven cases, such as temporary restraining order of “Song of Youth” TV series, have been selected into top 10 IP cases of Shandong. GOLFZON VISION computer software copyright infringement case was included into top 10 copyright protection case of Shandong, while “CK” trademark infringement case as best 10 IP cases of Brand Protection Committee of China Foreign Investment Association. QIPC won most awards at the 20th anniversary professional IP trial cases over the province.
QIPC Measures for Management of Expert Jurors (for Trial), Measures for Litigated Participation of Technical Investigators in Qingdao IP Court, and Rules and Regulations of Qingdao IP Court Expert Advisory Committee have been propelled. It completed the selection and appointment of the 2nd batch of technical consulting experts and technical investigators, 28 part-time technical investigators and 54 technical consulting experts, to ensure “four-in-one” effects in truth finding through technicalinvestigation, consultation, identification and expert jury.
Jurisdictional layout has been optimized. Courts at Licang district and Jiaozhou city shall be applied for approval on jurisdiction of IP cases. 6 courts boasted jurisdiction for most innovations. “Three-in-one” model ofIP adjudication, trial and jurisdiction was extended for centralized jurisdiction among two-tier counts.
IP infringement crimes were ratified by rule of law. In 2022, procuratorial organs
in Qingdao handled more than 200 IP infringement cases concerning production and sale of counterfeit food on well-known brand, clothing, and home furnishing, and OEM sanitary ware, effectively safeguarding the legitimate rights and interests of enterprises. 40 procuratorial suggestions were formulated and issued to courts and administrative organs. 20 problems were tackled for rectification in terms of trial procedurerectification, illegal enforcement, and slackness in duties, to ensure good governance effects.
Criminal prosecution, civil accountability, administrative violations, public interest damage were reviewed upon IPcase handling to form integratedmechanism. Linkage between higher and lower levels of procuratorates shall be coordinated for unified clue management, enforcement deployment, command work, and information release.
The case handled by QPP in which a travel agency in Qingdao sued a Beijing Internet technology company for copyright photographic works was the first case to exercise counterappeal rightproposed by municipal count and protested by provincial court. The case of Sun Moulin usingand sale of counterfeit trademarks handled by Jimo District Court was selected as typical case for centralized and unified prosecution among procuratorial organs in 2022.
QPS intensified the cracking down of criminal acts of IP. Special program such as “Kunlun 2022”, “Escort Winter Olympic and Two Sessions (NPC and CPPCC conference)”, “Centralized Renovation” was launched. In 2022, the city detected a total of 67 criminal cases of production and sale of fake and shoddy goods, and arrested 268 criminal suspects. 3 cases were applied for the supervision of MPS.
QPS
successfully detectedthe “October. 28th” case concerning fake registered trademark, captured 38 suspects, cracked down 12 criminal groups, and destroyed 23productionsites and sales dens, with a market value of 170 million yuan. MPSsent a congratulatory messageto commend such successful detection.
QPS Food and Drug EnvironmentalDetachment was recognized and complimented by SIPO and MPS for its outstanding achievements on IP protection in 2021.
（3）Stronger Customs Protection
QCD 
was dedicated to strict border IP protection by seizing 2,161 batches of commodities, involving587,900 infringing goods, up year-on-year by 13.2% and 0.5%. The investigated IP cases have been selected into QCD typical case for 16 consecutive years.
Special law enforcement was conducted to crack down motor vehicle parts and accessories infringement and counterfeiting, seizing a total of 210,000 filter elements, filters, and other infringements, protectingfair market order, health and property of citizens.
（4）Synergy effects stands out in IP protection
QIPC endeavored to establish the 2nd circuit court in Yantai city at the China (Yantai) IP Protection Center. Cross-domain protection agreements were signed with Weihai Administration of Market Regulation and Weihai Intermediate Court. Fast Track “three-level and multi-directional” mechanism was formulated with Weifang Administration of Market Regulation. Work meeting of “coordinating judicial and administrative protection of Jiaodong peninsula”was held to provide judicial convenience andto benefit people in Jiaodong Peninsula. Cross-domain asynchronous interrogation system was created to cater each featured case.
QPP summarized procuratorial supervision points, analyzed case data, and discovered clues in batches, turning them into big data models, and integrating into rapid data sharing platform for IP protectionto form an online connection mechanism.
QCD, Jinan Customs and SDAMRcounter-signed the Agreement on Strengthening Strategic Cooperation in Key Areas, for clue sharing and law enforcement cooperation, and improving services. Work mechanism for joint research and judgment of clues was built upwith QPS, by virtue of its big data platform for clue detection. The case of a company in Jining exporting “POKEMON” early education cardswas transferred to andsupervised by SPS.
Q
ACworked with Regional Comprehensive Economic Partnership (RCEP) service center to assist Shandong businesses better mastering and applying RCEP trade rules. It conducted such services as business consultation, dispute mediation, case trials on a regular basis, thus providing professional and international arbitration legal services for innovative businesses within RCEP Economic and Trade Cooperation Pilot Experimental Base.
V. Regulations reinforced to ensure industry order
In accordance with the deployment of SDMAR, QAMR strengthened supervision and guidance of 3 key businesses of overseas risk prevention and control on IP infringement such as Qingdao Impulse Total Fitness, and 4 businesses included in 2022 Shandong IP Protection Workstation Project such as Qingdao Tianan Digital Co., Ltd. Project undertakers were encouraged to sign contracts with QAMR to facilitate project implementation.
Record program intended to facilitate quick pre-examination for patent transformation.To serve rapid pre-examination of high-value inventions and creations, businesses and agencies in the field of marine and new-generation information technologies were recommended to carry out centralized review and filing. A total of 130 enterprises completedpatent filing through this channel.
Patent application behavior shall be strictly regulated to observe abnormal patent application practice. Strict verification of R&D and innovation capabilities of relevant units and individuals were carried out, with two batches of abnormal applications being inspected. QAMR reviewed and recommended precise management list of 309 patent applications to SDAMR.
The city conducted “Random and Publicity”law enforcement to intensify the supervision and inspection of agencies and market behaviors. Random inspection was carried out in 58 IP operating entities, 329 trademark agencies, 21 of which with substandard operation were gathered for rectification.
QCTBadvocated to incorporate copyright software work into long-term regime.Joint Conference on Software Legalization adjusted responsibilities of member units, urged relevant departments at district and city level to improve corresponding work mechanisms, and insisted on “looking back” verification.
VI. Services optimized for greater efficiency
QAMR provided guidance to National Demonstration Zone of IP Service Cluster (“Demonstration Zone”), among which, Laoshan district has pass the acceptance and assessment of SIPO. The “Demonstration Zone”boasted such services as agents, consultation, evaluation, analysis, trading, transformation, pledge, investment and financing. There have been 220 IP service agencies and more than 1,200 employees, which makes IP services extend to specialization and high-end value. Therefore, the IP service system has taken shape for coordination.
Pilot program of patent pledgeonline registration has been progressed. Qingdao strives to apply for the 2nd batch of national pilot for patent pledge online registration by seeking the approval of China Banking and Insurance Regulatory Commission (CBIRC) and SIPO. Together with CBIRC Qingdao Office, and the Qingdao Financial Supervisory Authority, the Work Plan and Management Measures aboutBuilding National Pilot of Patent Pledge Online Registration were issued to support the first batch of 18 pilot banking institutions attending to online IP pledge. As of the end of 2022, 459 loans have been offered to 726 businesses, with accumulated insurance amount of 1.745 billion yuan and loan amountof 1.663 billion yuan..
IP services continues to be improved. Qingdao Technology and Innovation Support Center of WIPO (TISC)(hereinafter referred to as “Qingdao Center”) promoted advocacy on SIPO policies, World Intellectual Property Organization (WIPO) excellent resources and international standard. National Overseas IP Dispute Response Center, Qingdao Branchhas formed a guiding system for information handling, capacity building, coordinating service center. Overseas offices presented in 12 countries (regions) around the world, while 14 liaison stations, 4 sub-stations and 10 support agencies were created within the city to serve business innovation and “go global”.
“Qingdao West Coast New Area Legal Service Alliance” (the “Alliance”) was established to be the first alliance of its kind over the province. Led by the Rights Protection Committee of Sino-Foreign Enterprise Confederation of West Coast New Area, the “Alliance” was initiated by 39 units, including the IP College of Shandong University of Science and Technology (SDUST) and Shandong Wincon Law Firm. It adopted the mode of council operation, with its members including well-known experts in IP talent pool and well-known lawyers of the IP Professional Committee of China Lawyers Association(CLA), aiming to provide professional and advanced legal services to resolve IP disputes.
QIPC paid a visit to Pilot Zone for Laixi-Laiyang Integrated Development, Beijing Automobile Manufacturing Plant (Qingdao) Co., Ltd., Qingdao Microelectronics Innovation Center, Qingdao Marine Biology Research Institute and other enterprises to improve judicial services for high-quality development and new industries advancement such as integrated circuits and bio-medicine.
QPP organized meeting with 9 well-known enterprises, including Haier, Hisense, and Tsingtao Brewery for advice and opinion, and intended to provide procuratorial services catering to their own businesses. “Legal education” special program was carried out to 18 key businesses for publicity.
QCTB submitted to the Publicity Department of Provincial Party Committee for the application of building Shandong Digital Copyright Trading Center by virtue of Qingdao Cultural Property Trading Center (“the Center”). The Center was dedicated to forging a music copyright service platform, and undertookthe only national pilot task of “blockchain + copyright” innovation within Shandong.
QAC jointly hosted the 2nd online training class on RCEP policy interpretation and utilization with China Council for the Promotion of International Trade (CCPIT), Qingdao Tax Service, State Taxation Administration, CCPIT Qingdao, and Shibei District Government, as well as universities and IP service agencies in Qingdao, and designed to offertargeted and accurate services for foreign trade businesses.
QCD assisted businesses in IP Customs filing. Over the year 2022, 597 new cases was put on file and 130 new rights holders were added in the province, all maintaining rapid growth. 5 newcompanies with independent IP, including Jining Haihang Hair Products Co., Ltd., were selectedto be key businesses within the nation, asthe total number amounted to 47.

Taken the advantage of Qingdao IP Public Service Platform(the “Platform”) and professional service agencies, non-profit traininghas been offered to senior leadership of enterprise, public leadership, IP practitioners, and scientific staff.900 training programs have been organized by category and level, benefiting 20,000 person-timesand enlarging IP professional team.
QIPC selected and appointed judges to conductcross-domain training,with diversified dispute resolution capabilities. Work symposium over IP jurisdiction adjustment, training and exchange of IP serviceswas held to improve competency.
QCTB organizes responsible persons of the Party and government organs, as well as major enterprises and institutions to receive training on software copyright, asset management and technical knowledge, to improve the profession of law enforcement personnel and raise the law-abidingawareness and self-discipline, thus laying a solid foundation for in-depth promotion of software legalization.
Qingdao Municipal Bureau of Justice organized representatives of QLA IP Committee and relevant judicial and administrative law enforcement agencies, enterprises and institutions to hold the “World IP Public Day Symposium and Seminar on the Application of IP Punitive Damages System”. Training seminar on “Patent Infringement Judgement and Litigation” was convened through working with the Platform. Meanwhile, training seminars and salons on IP law business was hosted with Nanjing Bar Association IP Committee.
QCD released theResponse to Law Enforcement Questions (2ndEdition), organized three sessions of service training, benefiting 300 person-times, to ensure enforcement standard. 4 project teams were set up in the Customs area for research on innovative Customs protection in Pilot Free Trade Zone and difficult law enforcement aroundRegional Comprehensive Economic Partnership Agreement, aiming to improve Customsprofessionalism. IP promotion utilized for raising awareness
On June20, 2022, the 3rd Qingdao Multinationals Summit (QMS) was inaugurated in Qingdao. Mr. Hu Wenhui, Deputy Director-general of SIPO, and Mr. Ling Wen, Vice Governor of Shandong, attended and addressed the forum. Leadership from SIPO IP Protection Department,SDAMR, and Supreme People’s Court of Shandong, as well asmultinational companies, delivered speeches. After the forum, SIPO held a closed-door meeting with responsible personnel from IP Protection Department and SDAMRto collect opinions and suggestions ofmultinational companies on China’s IP protection work, and provide in-depth exchanges on IP enforcement and overseas rights protection.
The Leading Group prevails in raising public awareness of IP protection, improving IP service and promoting IP culture, through such activities as “4.26 World IP Public Day”,“National IPR Publicity Week”, and “Serving IP on Thousands of Miles”. WeChat public account was selected into top 10 excellent cases for national IP information service. “Qingdao Practice” for patent pledge financingboasted coverage in leading medias such as People’s Daily and CCTV Finance. The practice was well-received by State Councilsupervision team, being replicated and promoted over the province under leadership instruction, and selected as typical case to support reform and development of private businesses.
Sponsored by China Market Regulation Newspaper, such works as“QAMR Service-oriented Law Enforcement”, and“How to do with patent infringement” were selected into the 4th National Market Supervision Micro Film, Video and Animation Collection and Exhibition, and being awarded annual platinum prize and excellent animation creation work.
QIPC and QPP jointly held a press conference to release the judicial IP protection in Qingdao and top 10 typical cases. Seminar on IP punitive damage system was hosted with QLA. QIPC played an active part in lecture theatre events as “IP Youth Talk” and “IP Powerhouse”for public interests, with China Court network. Innovative practice on judicial protection has been promoted through Court Daily, SPC Trial Update, Provincial Court Trial Reference, and Qingdao Reform.
QCTB published the proposal of Refusing Infringement and Piracy, Protecting Intellectual Property Rights, organized more than 50 on-site publicity activities, and distributed 6,000 copies of materials and books, to foster the atmosphere of copyright respect and protection. A series of promotion activities as “Green Bookmark Action” was hosted, 4 promotional videos and short videos on public service produced, 8,000 bookmarks and brochures and 15,000 “Green Bookmark” leaflets distributed, hence increasing the awareness of youth in safety and rule of law.
The 5th Qingdao International Copyright Trade Expo was held while launching four major activities as online trading, exhibition and display, summit forum, and protection publicity, with an exhibition scale of 20,000 square meters, attracting 188 excellent copyright enterprises at home and abroad, and more than 6,000 visitors, with contract value reaching 3 billion yuan.
QCD publicized over 10 times of CustomsIP protection policies and cases on the Xuexi.cn, Dazhong Daily, Guomen Times and other media. In cooperation with QAMR and QCTB, QCD put up publicity posters in Customs declaration hall, and distributed more than 2,000 copies of advertising brochures, covering 200 enterprises within jurisdictions.
